Qualifications:
A. Both parties shall be of minimum age, i.e. the male shall be 22 years old or above, the female shall be 20 years old or above;
B. Both parties shall be voluntary and without spouse;
C. Both parties have no direct family relationship or collateral relationship within three generations;
D. No disease which is improper for marriage;
E. Both parties shall go together to the Marriage Registration Bureau to handle the marriage registration and get the Marriage Certificate.
Procedures:
As for the Chinese, the following documents are required:
A. the Hukou Book and ID card;
B. statement made which indicates he/she has no spouse and no direct family relationship or collateral relationship within three generations with the other party.
As for citizen from HK, Macau and Taiwan, the following documents are required:
A. valid passport and identification;
B. statement made which indicates he/she has no spouse and no direct family relationship or collateral relationship within three generations with the other party, which shall be notarized in HK, Macau or Taiwan accordingly. The statement shall be valid for only 6 months.
As for oversea Chinese, the following documents are required:
A. valid passport;
B. attestation which indicates he/she has no spouse and no direct family relationship or collateral relationship within three generations with the other party, which shall be issued by the Notary Public Office and legalized by the Chinese embassy in his/her country, or which shall be issued by the Chinese embassy in his/her country. The attestation shall be valid for only 6 months.
As for foreigner, the following documents are required:
A. valid passport;
B. attestation which indicates he/she has no spouse, which shall be issued by the Notary Public Office and legalized by the Ministry of Foreign Affairs in his/her country and the Chinese embassy in his/her country, or which shall be issued by the his/her country’s embassy in China. The attestation shall be valid for only 6 months.
For foreigner who has been in China for residence for 6 months or above, or holds Residence Permit issued by Chinese government, such attestation can be issued by his/her country’s embassy in China.
Marriage Registration to be delayed:
In the following situations, the Marriage Registration shall be delayed:
A. Either party has disease which is improper for marriage;
B. The marriage registration was cancelled and no expiration for the term of 6 months.
